IMPLEMENTING UNMIK REGULATION NO. 2000/41 ON THE ESTABLISHMENT OF THE ADMINISTRATIVE DEPARTMENT OF SPORTS

 

 

The Special Representative of the Secretary-General,

 

Pursuant to the authority given to him under section 5 of United Nations Interim Administration Mission in Kosovo (UNMIK) Regulation No. 2000/41 of 10 July 2000 on the Establishment of the Administrative Department of Sports,

 

Taking into account sections 2.1 (b) and 2.2 (d) of UNMIK Regulation No. 2000/41 and UNMIK Regulation No.1999/22 of 15 November 1999 on the Registration and Operation of Non-Governmental Organizations in Kosovo,

 

For the purpose of regulating the activities of Sports Federations, Associations and Committees in Kosovo,

 

Hereby gives the following Administrative Direction:

 

 

Section 1

Establishment and Registration

 

The Sports Federations, Associations and Committees in Kosovo (hereinafter “the sports organizations”) in order to operate as legal entities engaged in the development of sports in Kosovo, and enjoy the benefits specified in section 3 below, shall be established and registered in accordance with UNMIK Regulation No. 1999/22 and comply with the requirements set out in section 2 below.

 

 

Section 2

Statutes of the Sports Organizations

 

Statutes of the sports organizations shall comply with the following requirements:

 

(a)    The promotion of sports in the spirit of tolerance and the Olympic ideals of peace, solidarity, friendship and fair play;

 

(b)    Membership shall be open to all habitual residents of Kosovo, irrespective of sex, race, color, language, religion, political or other opinion, natural, ethnic or social origin, association with a national community, property or birth;

 

(c)    At least thirty (30) percent of the members shall be women;

 

(d)    At least ten (10) percent of the members shall be from ethnic minority communities;

 

(e)    All members shall have the right to vote for, and to be elected to, positions on the Board of the Assembly of members;

 

(f)      The Board shall be composed of the following members: one (1) President, up to three (3) Vice Presidents, one (1) Secretary and one (1) Treasurer, who shall be elected for a term of four (4) years; three (3) members who shall be elected for a term of two (2) years; and three (3) members who shall be appointed by the President for a term of two (2) years.  The period of office for each member on the Board may be renewed for one (1) further term;

 

(g)    Elections shall be carried out by a secret ballot. The voting list shall include the names of the candidates and the positions on the Board for which they are seeking election;

 

(h)    At least thirty (30) percent of the candidates on the voting list shall be women;

 

(i)      At least ten (10) percent of the candidates on the voting list shall be from ethnic minority communities;

 

(j)      The sports organizations shall ensure that at least one (1) of the following positions on the Board – President, Vice President, Secretary or Treasurer is held by a woman and that at least one (1) is held by a member of an ethnic minority community;

 

(k)    The President and the Treasurer shall maintain the sports organization financial records and shall report on it to the Board, the Assembly of members and the Administrative Department of Sports;

 

(l)      The Board shall meet as often as necessary, but not less than once a month;

 

(m)  The Assembly of members shall meet at least twice during a calendar year; and

 

(n)    The sports organization logo, symbol, motto and flag shall be clearly described and shall not contain any political, religious, ethnic, racial or national references.

 

 

Section 3

Recognition by the Administrative Department of Sports

 

The sports organizations that comply with the provisions set out in the present Administrative Direction shall be recognized by the Administrative Department of Sports as officially representing a particular sports discipline in Kosovo and shall be eligible to apply for grants-in-aid, and other assistance that may be available, from the Administrative Department of Sports.

 

 

Section 4

Entry into Force

 

The present Administrative Direction shall enter into force on 15 August 2000.
