ADMINISTRATIVE DIRECTION NO. 2000/26
The Special Representative of the Secretary-General,
Pursuant to the authority given to him under Section 6 of United Nations Interim Administration Mission in Kosovo (UNMIK) Regulation No. 2000/39 of 8 July 2000 on the Municipal Elections in Kosovo,
Hereby gives the following Administrative Direction:
1.1 In accordance with Section 4.2 of UNMIK Regulation No. 2000/39 (hereinafter “the Regulation”), each candidates’ list shall include at least thirty percent of female candidates in the first fifteen candidates. Within the first fifteen candidates on each candidates’ list, at least one female shall be placed among the first three candidates, and at least one female shall be placed in each full set of three candidates thereafter. This rule shall not apply to those lists comprised of less than three candidates.
1.2 In the event that a political party, coalition or citizens initiative has not complied with Section 4.2 of the Regulation, it shall be subject to a reduction in seats allocated pursuant to Section 5 of the Regulation equal to the number of the deficiency of female candidates. This sanction shall apply only where the number of seats that would have been allocated had there been compliance is greater than the number of candidates on the portion of the list that is in compliance.
1.3 Where the number of seats allocated is reduced in number due to non-compliance with Section 4.2 of the Regulation, the seats that would otherwise have been allocated had there been compliance, shall be allocated to the next political party, coalition, citizens’ initiative or independent candidate that qualifies for a seat according to the distribution formula as established by Section 5 of the Regulation and that meets the requirements of Section 4.2 of the Regulation and Section 9.10 of Electoral Rule No. 2000/9.
The present Administrative Direction shall enter into force on 23 October 2000.
